Our Terms & Conditions
Terms & Conditions
Welcome to Friends of Moby Dick Whale Watching (“we,” “our,” or “us”). We appreciate your trust and support of our family-run Icelandic business, dedicated to creating unforgettable travel experiences. By using our services or booking a tour through our website, you agree to these Terms & Conditions. Please read them carefully.
1. General Terms
1.1 Booking Channels
Our services are sold via our official website (www.friendsofmobydick.is) and through partner agencies. These terms apply only to bookings made directly through our website. We are not responsible for issues arising from bookings made through third-party vendors.
1.2 Communication
All communication regarding reservations, changes, or cancellations must be made in writing and can be sent via email or post if time allows.
2. Tour Information
2.1 Tour Adjustments and Cancellations
We reserve the right to cancel, alter, or reschedule tours for safety reasons, including adverse weather, road conditions, or unforeseen events. Changes may occur on short notice to maintain safety standards.
2.2 Departure Information
Tours depart from designated harbors, as indicated on your confirmation voucher. It is the customer’s responsibility to arrive on time for check-in and boarding.
2.3 Sightings and Complimentary Tickets
While we strive to provide exceptional experiences, wildlife sightings are not guaranteed. In the event of no sightings, we offer complimentary tickets valid for two years, allowing you to join another tour (subject to availability).
3. Booking and Payment
3.1 Booking Process
Bookings can be made up until the tour start time, provided availability. Confirmation is only guaranteed once payment is completed, and a confirmation email is received. A voucher with tour details will be sent to the provided email address.
3.2 Payment Methods
We accept major credit cards, including Mastercard, Visa, and American Express. Payments made online incur no service fees. Your credit card statement will list Friends of Moby Dick Whale Watching as the merchant.
3.3 Customer Responsibility
Customers must safeguard their confirmation vouchers and present them when required by the service provider.
4. Changes, Cancellations, and Refunds
4.1 Change of Reservation
Changes to reservations must be requested at least 12 hours before departure. Requests submitted later may incur additional fees, depending on our policies.
4.2 Cancellations Requests
Our Cancellation policy is FREE of charge 24h prior the departure. Cancellations must be made in writing and sent to info@friendsofmobydick.is - for cancellations made less than 24 hours (or 48 hours for group bookings) before departure, the full tour price will be charged.
4.2 Cancellations due to unforeseen events
If a cancellation occurs on our side due to unforeseen events or unfavorable weather conditions, we will contact you directly as soon as a decision is made. Communication will use the contact details provided in the booking. If you booked through a third-party agency, we may not have your direct contact details and will notify the agency instead. This may result in a delay in receiving the cancellation notice, which is beyond our control.
4.4 Refunds
We offer full refunds for cancellations made more than 24 hours (48 hours for group bookings) before departure or if the cancellation is initiated by us due to unfavorable sea conditions or other weather factors. Once a tour has started, no refunds will be issued. Bookings made through third-party agencies may also be subject to the cancellation policies of that agency.
5. Liability and Safety
5.1 Assumption of Risk
Participation in our tours is at your own risk. Tours are conducted in natural environments, and conditions may vary. Customers must act responsibly and follow safety instructions.
5.2 Limitations of Liability
We are not liable for personal injury, loss, or damage to personal property during tours, except as required by law.
5.3 Force Majeure
We are not responsible for cancellations or alterations caused by events beyond our control, including weather, seismic activity, or other natural phenomena.
6. Special Provisions
6.1 Passengers with Special Needs
We accommodate foldable wheelchairs on our larger boat free of charge. Please notify us in advance for specific accessibility needs because we may not be using that boat on the day.
6.2 Children’s Discounts
Discounts for children vary by service. Details will be provided at the time of booking.
7. Privacy and Security
7.1 Data Collection
We collect personal information (e.g., name, email, phone number) to process bookings and provide updates. We do not share, sell, or rent your personal information to third parties.
7.2 Data Security
All payment transactions are encrypted using SSL technology. Personal information is securely stored and handled according to applicable privacy laws.
